The California DMV Points System
Start fighting your traffic ticket in under a minute
Have you ever heard of the California DMV points system? Odds are, you haven’t. This system rates a traffic penalty and adds a corresponding point amount to the offender’s license. As points add up, worse implications may occur such as the suspension of one’s license. Let’s take a look at how the DMV points system works, and how to get your points revoked.
The California DMV points system was established to monitor safety habits of drivers within California using a quantitative, easy-to-understand format. According to the rules of the California DMV points system, traffic violation points are added to an individual’s driving record when the DMV receives a traffic violation or accident report. The number of points marked on the driver’s record varies based on the severity of the offense committed. Larger offenses result in greater point values, and more serious consequences. Incurring a large number of points will result in a minimum of license suspension, with possible steep fines or even jail sentences. If you already have points on your record, future infractions may lead to more expensive tickets.
Not every violation will add points to a license. The main traffic violation type adds points to your license, while the three others do not. A moving violation is any violation of the law committed by the driver while the vehicle is in motion. For example, a red light ticket California is a big deal. This type puts DMV points on your license.
The other three types do not add points to your license, however. Non-moving violations are violations such as parking tickets and fix-it tickets regarding broken car equipment. Paperwork violations relate to insurance or other documentation. Cell phone violations include talking on your cell phone while driving.
You can rest easy knowing these three infraction classes will not penalize your license with points, however you should still attempt to fight these tickets, as some will remain on your record and negatively affect insurance rates. Drivers can also be penalized under the “Negligent Operator Treatment System.” Violations that encompass this system include exceeding the speed limit according to traffic control devices. This corresponding penalty value is one point. A driver will also obtain one point for disobeying a traffic officer. If an individual operates a vehicle in a reckless manner, this results in two points. Driving under the influence of drugs or alcohol results in two points.
Furthermore, commercial drivers can receive moving violation points up to one and a half times the normal value. The same goes for young drivers under the age of 18.
RELATED: Does a Traffic Ticket Affect Insurance in California?
Drivers who accumulate four penalty points in 12 months, six in 24 months, or eight in 36 months will have their driver’s license suspended for an extended period of time depending on the California county they reside in.
California traffic tickets will stay on your record for the next 3 years. However, this depends on the severity of the offense such as DUI which can stay on your record for 10 years.
The vital question for drivers: “How do I remove points from my record?” The simple answer is time. As long as you keep a clean driving record for a designated amount of time, your points will be cleared automatically. Violations that add one point to a driving record will be cleared after 39 months. Points for serious violation such as DUIs or hit and run incidents will stay on the violators record for at least ten years. Failure to appear in court for any traffic violation no matter the severity will result in the points remaining on your driver’s record for five additional years.
Furthermore, failure to appear in court for a DUI will keep points on your record for an additional 10 years. Of course, there are simple yet effective methods of avoiding court and beating your infraction. Doing this will also remove your accumulated points, if successful. On the other hand, if you have more time and an eligible traffic citation, you may be able to attend a California traffic class which can help dismiss your ticket, remove points, or earn auto insurance discounts.
It is important to take the correct actions in fighting traffic tickets, especially regarding DMV points. Anyone can check the status of their California driver’s license and order a driving report card to make sure that their driver’s license is still on good standing.
